1. Conclusion of contract, terms of payment
The contract between the guest and Zermatt Premium Apartments (Agency in the following) is initiated upon the confirmation of the reservation with the confirmation of the reservation.
2. Additional costs | supplementary costs
All additional costs (such as final cleaning, laundry, electricity, gas, heating, etc.) are included in the rental price. Local tourist taxes are not included in the rental price and must be paid together with the rental price before arrival (depending on the payment conditions of the reservation).
Supplementary costs which are not included in the rental price (e.g., transfers, bread service, breakfast etc.) will be invoiced and must be paid when the service has been booked.
3. Handover of the rental object | complaints
The rented property will be handed over to the guest in a clean and contractually impeccable condition. Should the guest take over the rental object late or not at all, the full rental price must still be paid.
If, upon arrival of the guest(s), defects or missing inventory is detected, the guest(s) must notify the Agency in writing by 10.00 a.m. at the latest on the day after arrival. Otherwise, the rented property shall be deemed to have been handed over in perfect condition.
4. Careful use of the rental object
The guest is obliged to use the rented property and the facilities with care. Furthermore, the guest must respect the house rules and show consideration for other residents and neighbors. In the event of any damage, the Agency must be informed immediately.
The rented property may only be occupied by the maximum number of persons, stated in the contract or in the booking confirmation. Subletting is not permitted.
The guest(s) must ensure that co-guests comply as well with the obligations set out in this contract.
If the booking guest or co-guests violate the obligations of careful use or if the flat is occupied by more than the contractually agreed number of persons, the Agency may terminate the contract without further notice and compensation, as well as demand an additional payment.
Pets are not allowed in any of the flats we offer.
In the event of a breach of the rules by the booking guest or co-guests, the flat must be vacated immediately and an additional charge will be made in accordance with the incurred damage.
A key that is lost during the stay or is no longer in the apartment at the end of the stay will be charged at 100 CHF (for replacement).
We recommend that all guests have a liability insurance and a travel cancellation insurance.
5. Return of the rental object
The rental object is to be returned in a contractually impeccable condition together with the original inventory.
This means that the flat must be left broom-cleaned, the dishes completely washed, and the rubbish properly disposed of.
The guest is obliged to replace missing or broken inventory.
6. Cancellation conditions
Our cancellation policy is as follows:
This also applies in case of restrictive measures such as closure of ski areas, access roads, canceled flights, quarantine, travel bans, legal decrees, or similar, COVID-19 measures. We recommend purchasing travel insurance.
The rental price of a "non-refundable" rate must be paid to the agency within 7 days of booking via bank transfer or credit card (Stripe). Stripe can be used only for bookings under 5.000 CHF.
The cancellation conditions that were displayed to you during the booking process and accepted by you during the booking process apply, both on the Zermatt Premium Apartments website and on the selected booking platforms on the Internet.
The rental price must be paid to the agency by bank transfer or credit card (Stripe) no later than the last day of the cancellation period. Stripe can be used only for bookings under 5.000 CHF. The agency reserves the right to request a non-refundable 30% deposit of the rental price upon receipt of booking.
The Agency reserves the right to take legal action if bookings are not paid for or credit card payments are disputed, although according to the terms and conditions and booking conditions, the amount is owed to the agency.
A processing fee of 200 CHF generally applies to refunds. This will be deducted from the refund amount.
We recommend that all guests have a liability insurance and a travel cancellation insurance.
7. Force majeure
If the rental object is not available due to force majeure (environmental disasters, natural forces, official measurements, hygiene measurements, etc.), unforeseeable or unavoidable events, the lessor is entitled (but not obliged) to offer the guests a replacement object, excluding any claims for damages. Regulations of governments from abroad and/or Switzerland, entry and exit bans, quarantine regulations etc. do not constitute force majeure.
8. Liability
The Agency is liable for ensuring that the booking is made properly and that the contract is fulfilled in accordance with the chosen conditions. Liability is excluded for omissions on the part of the booking guest or fellow guests, for unforeseeable or unavoidable omissions on the part of third parties, force majeure or events which the lessor could not, despite taking care, have foreseen or averted. The booking guest is liable for all damages caused by him/her and fellow guests.
In the event of an obvious incorrect booking due to system-related errors in the booking system, the agreed prices shall be null and void. In this case, the Agency has the right to cancel the booking without compensation.
9. TV, internet and mobile phone signals
We accept no liability for technical problems, affecting the Internet, TV or mobile phone signals if these cannot be received in the house or if their reception is disturbed.
10. Payment information
Payments for which a bank transfer has been agreed, have to be transferred within the agreed time period to the following account:

If payments are not received to the Agency by the agreed date, the Agency is entitled to dissolve the contract without further notice and to make the apartment available for further bookings. Any expenses or rental payments remain owed to the Agency in accordance with the accepted contract and cancellation policies.
11. Applicable law and place of jurisdiction
Swiss law is applied. The exclusive place of jurisdiction is agreed to be the location of the rental object.
